Historical Background

John Locke’s philosophy of self-defense and the defense of the innocent centers on the law of nature and the fundamental right of self-preservation and heavily influenced the American Founding Fathers:

In the Second Treatise of Government, Locke argues that in the state of nature every person is free and equal, bound by the law of nature which commands that “no one ought to harm another in his life, health, liberty, or possessions.” When someone violates this law by initiating force—threatening or attacking the life or liberty of another—they place themselves in a state of war and forfeit the protection of that law.

Because the primary law of nature is the preservation of mankind, every individual has the right not only to defend his own life but also to defend the lives of others. Locke holds that the executive power of the law of nature belongs to every person, allowing one to restrain or, when necessary, destroy an aggressor who endangers the innocent. The aggressor, by using unlawful force, has abandoned reason and become like a wild beast that may be destroyed for the safety of others.

In short, Locke treats the safety of the innocent as the higher good. The right of self-defense and the defense of others is not a grant of government but a natural right that exists prior to and independent of civil society. Any law that systematically punishes the defender while protecting the aggressor violates this natural order.
